In a unanimous vote, the Metro Board of Zoning Appeals on Thursday approved Buckingham Cos.’ request for a special exception to allow its planned residential tower in the Gulch to rise 38 stories.

The Indianapolis-based developer overcame opposition from some residents of the nearby Icon in the Gulch condo tower. Their concerns included potential impact on sunlight to their courtyard swimming pool.

An agreement between Buckingham and the Terrazzo high-rise, mixed-use building directly across from the proposed project site at 12th and Division played a role in the developer winning approval.
